国家林业局公安部关于加强森林公安队伍建设的意见

为深入贯彻党的十六大精神,认真实践“三个代表”重要思想,全面贯彻落实《中共中央 国务院关于加快林业发展的决定》、《中共中央关于进一步加强和改进公安工作的决定》和胡锦涛总书记等中央领导同志关于公安工作和公安队伍建设的重要批示精神,切实加强森林公安队伍的建设和管理,做到从严治警、执法为民,现提出如下意见。
一、认清形势,明确任务
1.森林公安工作面临的形势。森林公安是国家林业部门和公安机关的重要组成部分,是具有武装性质的兼有刑事执法和行政执法职能的专门保护森林及野生动植物资源、保护生态安全、维护林区社会治安秩序的重要力量。多年来,在各级党委、政府和林业、公安部门的领导下,森林公安机关和广大森林公安民警忠实履行法律职责,有力地打击了各类破坏森林和野生动植物资源的违法犯罪活动,为生态建设和林业发展做出了巨大贡献。
党的十六大提出全面建设小康社会的奋斗目标,把生态良好作为全面建设小康社会的重要标志之一。《中共中央 国务院关于加快林业发展的决定》为新世纪林业发展指明了方向。在林业实施六大重点工程,推进历史性转变,实现跨越式发展的进程中,森林公安队伍既是建设者,更是建设成果的守护者,肩负的任务越来越繁重。新时期,中央领导同志对加强公安工作和公安队伍建设作出了重要批示,要求抓住队伍建设这个根本,坚持从严治警,做到执法为民,对公安队伍建设提出了新的更高的要求。《中共中央关于进一步加强和改进公安工作的决定》和第二十次全国公安会议进一步明确了新世纪新阶段公安工作的奋斗目标。与形势发展和中央领导的要求相比,森林公安队伍还存在着警力不足、队伍建设不规范、部分人员素质较低、经费渠道不畅等问题,亟待加以解决。森林公安必须适应各方面要求,与时俱进,大力加强队伍建设。
2.森林公安队伍建设任务。加强森林公安队伍正规化建设,实行统一、规范、严格的管理,是公安机关的性质、任务和工作特点所决定的,也是促进优良警风的形成,提高队伍整体素质和战斗力,确保严格、公正、文明执法的重要前提。今后一个时期森林公安队伍建设的任务是:以邓小平理论和“三个代表”重要思想为指导,深入贯彻党的十六大精神、《中共中央 国务院关于加快林业发展的决定》、《中共中央关于进一步加强和改进公安工作的决定》和第二十次全国公安会议精神,按照建设过硬班子、纯洁公安队伍、树立良好警风、提高执法水平的要求,不断增强大局意识、政治意识、忧患意识、群众意识和法治意识,坚持与时俱进,坚持执法为民,大力推进队伍正规化建设,全面提升森林公安工作的水平和森林公安队伍的战斗力,努力建设一支政治坚定、业务精通、作风优良、执法公正的森林公安队伍,更好地为生态建设和林业跨越式发展服务。
二、加强思想政治建设,树立执法为民思想
3.加强政治思想教育。要组织广大森林公安民警深入学习党的十六大精神和“三个代表”重要思想,使其树立正确的世界观、人生观、价值观,忠实履行党和人民赋予的职责,做到理想信念坚定,在思想上、政治上、行动上始终同党中央保持高度一致。
4.牢固树立执法为民思想。要适应新形势新任务的要求,进一步端正执法思想,转变执法观念,要真正把人民群众的呼声作为第一信号,把人民群众的需要作为第一选择,把人民群众的利益作为第一考虑,把人民群众的满意作为第一标准,切实做到人民公安为人民。要正确处理打击与保护、管理与服务、执法与守法的关系。要明确为谁执法、为谁服务这个根本问题,积极争创人民满意单位和争当人民满意民警。
5.弘扬爱岗敬业精神。要教育广大森林公安民警充分认识到做好森林公安工作对于全面建设小康社会的重要意义,牢固树立“以林为业、以警为荣”的思想,不怕牺牲,勇于奉献,自觉投身到新世纪林业建设事业中。广大森林公安民警既要深入学习政治理论,又要深入学习公安业务知识,切实提高做好森林公安工作和为人民服务的本领。
三、严格干部管理,建设过硬班子
6.严格执行森林公安机关领导干部双重管理制度。要制定森林公安机关领导干部双重管理制度的具体实施办法,健全双重管理程序性规定,进一步明确主管、协管的职责权限。各级林业主管部门在任免、调动森林公安机关正职领导干部时,要事先征得所在地公安机关和上级森林公安机关同意后,方可按任免权限和有关程序办理;森林公安机关领导班子其他成员的任免,要征求所在地公安机关和上级森林公安机关的意见。根据干部管理权限,需要由当地组织、人事部门任免、调动的森林公安机关领导干部,各级林业主管部门要积极做好协调工作,认真协助组织、人事部门履行相关程序。对未执行干部双重管理制度任免、调动干部的,上级森林公安机关不予承认。
7.落实领导班子考核制度。要加强对各级森林公安机关领导班子的考察与管理,建立考核制度,明确考核标准。上一级森林公安机关要配合有关部门对下一级森林公安机关领导班子及成员进行考核,对于考核结果优秀的要进行表彰,对连续两年考核末位的单位以及其他需要调整领导班子的,应及时提出建议,林业主管部门要充分尊重上级森林公安机关意见。要建立健全干部谈话、诫勉制度和个人重大事项报告制度。要严格落实领导干部责任追究制度、实行引咎辞职制度和责令辞职制度。森林公安机关新任领导干部在正式任命前,上级森林公安机关主要领导要与其进行谈话。
8.加强领导班子建设。要制定森林公安机关领导干部任职资格制度,选好配强各级森林公安机关领导班子。要按照“政治上强、开拓创新、团结协调、廉政勤政”的要求,选派政治强、作风硬、熟悉森林公安工作、具有丰富工作经验和较强组织领导能力的优秀干部到森林公安机关的主要领导岗位。要积极向党委、政府汇报,争取将具备条件的各级森林公安机关主要负责人实行高配,或进入本级林业主管部门的领导班子。森林公安机关新任领导干部在正式任命前,要进行公示,接受监督。要重点加强对县级以下(含县级)基层单位领导班子的建设。要注重对森林公安机关后备干部的选拔和培养。
四、加强队伍管理,推进正规化建设
9.规范机构设置和警力配备。要积极协调当地政府有关部门,尽快统一森林公安机关机构名称,规范设置森林公安机构及其内设部门。森林公安机关要逐步实现从管理型向管理兼实战型转变。要认真落实森林公安派出所要由上级森林公安机关直管的规定,目前仍由林场、自然保护区、森林公园等单位管理的森林公安派出所要尽快调整为由上级森林公安机关管理。要根据森林及野生动植物资源保护任务的实际需要,合理配置森林公安警力。要精简机关,充实一线,优化整合森林公安的警力结构。派出所警力配备人数不得少于5人。
10.强化队伍管理。各级森林公安机关的领导同志要以强烈的政治责任感,始终把队伍管理置于重要位置,以深化改革为动力,以提高队伍整体素质和战斗力为目标,以调动和激发广大民警的积极性和创造性为核心,以加强正规化建设为重点,坚持不懈地抓好队伍管理。要狠抓《公安机关人民警察内务条令》和《公安机关窗口单位服务规范》的贯彻落实,全面实行“一岗双责”制度。要进一步规范上下级森林公安机关的事权划分,理顺上级森林公安机关对下级公安机关工作的领导和指挥关系,确保警令畅通。要严格警纪,集中整治突出问题,树立良好警风。要改善基层办公条件,切实做到“人要精神,物要整洁,说话要和气,办事要公道”,树立森林公安机关良好形象。
11.严把队伍“入口关”。要制定森林公安机关人民警察省级统一招录办法。录用主任科员以下森林公安民警,要由省级森林公安机关统一组织从大专以上高等院校应届毕业生中招录,同等条件下,优先录用公安高等院校毕业生。对转任、调任和接受军转干部,除拟任县级以上森林公安机关领导班子成员外,由省级森林公安机关统一组织入警考试,考试未合格的不得录用。按照授权,省级森林公安机关要严格审批森林公安民警警籍;国家林业局森林公安局要严格警衔的审核、审批。
12.畅通队伍“出口”。各级林业主管部门和森林公安机关要按照《人民警察法》、《公安机关人民警察辞退办法》和其他有关规定,对那些不具备人民警察条件,不适合在森林公安机关继续工作的人员要予以调整,特别是对那些纪律散漫、作风松弛;耍特权,侵犯公民合法权益;酗酒滋事或经常酗酒;警容不整、举止不端;私自将警械、警服、警衔标志转借、赠送他人;文化、业务素质低下等不适合从事公安工作的森林公安民警要坚决予以辞退。对严重违反“五条禁令”或有其他严重违法、违纪行为的民警要坚决予以开除。
13.实行激励机制。要根据改革的精神,加强制度建设,规范森林公安队伍的组织人事管理,深化人事制度改革,实行科学的人员分类管理制度,逐步形成公开、平等、竞争、择优的用人机制。逐步在队伍管理中建立并实行“竞争上岗、绩效考核、低分培训、末位调整”制度,实现队伍的动态管理,做到能者上、庸者下、劣者出。
14.进一步规范立功创模活动。要把立功受奖、立功创模作为队伍管理的一项重要措施,通过表彰先进,弘扬正气,在队伍中形成争先创优的良好氛围。立功创模要向基层倾斜,注意发现基层所队和民警的先进事迹。要注重培养热情服务、执法为民的先进典型。要健全完善表彰奖励制度,使表彰奖励工作进一步规范化。要加强对先进典型的跟踪培养和教育,切实从政治、思想、工作和生活上给予关心爱护,使其永葆先进性。
15.提高队伍管理的科技含量。要加快以“金盾工程”为核心的森林公安队伍管理人事信息系统的建设。要充分利用现代科技手段管理队伍,使队伍管理工作更加规范化、科学化,提高队伍管理的效率和质量。
16.坚持从严治警。要把贯彻执行“五条禁令”作为队伍建设的长期任务,重点加强对基层尤其是所队长的教育和管理,采取切实有效的措施常抓不懈。要加强养成教育,规范警容风纪和民警执法行为。要以贯彻执行“五条禁令”为突破口,建立健全规章制度,切实加强民警的日常管理,实行森林公安机关和民警的绩效考核,坚持从严治警。要认真落实“四个坚决”的要求,严格执法程序,严格管理规定,坚决杜绝民警严重违法违纪案件的发生。各级林业主管部门对森林公安队伍建设负有重要的领导责任,连续发生多起森林公安民警违反“五条禁令”或其他重大违法违纪案件的,林业主管部门领导要到上一级林业主管部门进行检讨,上一级林业主管部门可视情况追究其责任。
五、严格训练,提高民警素质
17.加强民警教育训练。制定全国森林公安机关民警教育训练规划、大纲、专业教材,切实加强训练的规范化建设。要实行民警上岗和首任必训,职务、警衔晋升必训,基层和一线民警每年的实战必训,确保每个民警每年参加一次训练。要注重训练质量,实行教考分离和分级训练制度。要根据形势的变化和科技的发展,及时调整、充实教育训练内容。要列出不低于森林公安机关业务经费5%的经费用于民警的教育训练。
18.强化民警实战技能训练。要根据实战需要来组织民警的训练,建立适应实战需要的训练体系。要通过模拟教学、现场教学、案例教学、实战演练来提高民警的实战技能。要对民警进行体能、技能和战术的训练。
19.加强训练基地和师资建设。要加强森林公安机关训练基地建设,警力在2000人以上的省、自治区、直辖市应建立训练基地。其他省、自治区、直辖市也应积极创造条件建立训练基地。要加强森林公安教育训练单位师资队伍建设,提高教育训练水平,努力建设一支专兼职结合的高素质教官队伍。要科学制定分级分类的教育训练内容,积极创新训练方法,逐步推行“战训合一”的训练模式。要进一步建立完善森林公安教育训练单位教师和森林公安机关业务骨干双向交流的制度。
六、加强监督,切实解决违法违纪问题
20.加强警务督察工作。县级以上森林公安机关要设立警务督察机构,设立专门或机动警务督察队,按标准配备督察装备器材;要围绕上级森林公安机关的部署,针对突出问题,积极开展警务督察活动。
21.强化监督检查。林业、公安部门的监察、警务督察机构要加强对森林公安机关的监督检查。森林公安机关要积极推行警务公开,聘请特约监督员,广泛接受社会各界、人民群众和新闻舆论的监督。要妥善处理人民群众来信、来访和社会各界的监督意见,并及时反馈有关办理结果。
22.加大违法违纪案件的查办力度。对森林公安民警违反政治纪律、贪赃枉法、滥用枪支警械、违反规定饮酒、酒后驾车等违法违纪问题,要严肃查处,对查办有阻力的案件,上级森林公安机关要挂牌督办。上级森林公安机关对违法、违纪的森林公安民警可依据有关规定直接提出处理意见,民警所在的林业主管部门原则上应予以接受,并按照干部管理权限和程序进行办理;同时,森林公安机关直接办理违法、违纪民警警衔的延期晋升、降级和取消。
七、加强领导,做好警务保障
23.认真落实“从优待警”政策。要加大工作力度,广开经费渠道,积极筹措资金,确保中央决定的公安民警生活待遇高于地方、略低于军队的工资待遇在森林公安机关得到落实。要认真落实国家有关“从优待警”政策,兑现并根据国家经济和社会发展水平不断提高森林公安民警岗位、警衔等有关津贴,落实民警年休假和体检制度,妥善解决民警的奖励、职级、抚恤、医疗、保险等政治、经济待遇。要尽快建立森林公安民警保险制度,提高抚恤标准。各级林业主管部门要优先解决森林公安民警住房和子女入学、入托等方面的实际困难。要多渠道、多方式筹集抚恤资金,加大森林公安英烈抚恤力度。
24.理顺经费渠道。要认真做好理顺森林公安机关经费渠道工作,建立森林公安经费保障机制,研究制定森林公安经费开支定额,装备配备标准,努力解决森林公安经费保障问题。要按照国家有关规定,加大对森林公安机关办公经费、办案经费、装备经费和基础设施建设经费的投入,确保森林公安机关高效运转。
25.大力宣传先进典型。要及时发现、大力宣传森林公安队伍中忠于职守,敬业爱民,在平凡岗位上做出突出贡献的英雄模范人物,充分发挥先进典型的示范、引导作用。要通过宣传先进典型,进一步弘扬正气,振奋警心。
26.建立森林公安机关领导责任制。森林公安机关的各级领导,特别是主要负责人要把更多精力放在加强队伍建设上,形成队伍建设和业务工作两手抓,队伍建设和业务工作互相促进的良好局面。要建立森林公安机关队伍建设主要负责人责任制,领导班子成员要一岗双责,切实负起责任。要以身作则,率先垂范,带头执行各项规章制度。既要坚持严格管理队伍,又要关心爱护基层民警,帮助他们解决实际困难。要切实转变工作作风,经常深入基层,研究解决具体问题。要带头加强学习,不断提高自身的政治、业务素质,提高分析问题、解决问题的能力和驾驭复杂局面的本领。
27.加强森林公安机关政工部门建设。各级森林公安机关都要加强政工机构建设,政工部门的主要领导由森林公安机关副职领导干部兼任或专任。要充分发挥政工部门在队伍建设中的作用,加强政工队伍建设,加强人员培训,保持队伍相对稳定。
28.加强对森林公安工作的领导。要继续坚持林业、公安部门的双重领导。各级林业、公安部门要充分认识到新形势下加强森林公安队伍建设的极端重要性,主要领导要亲自过问,分管领导要具体抓,要定期研究森林公安工作,切实帮助解决存在的困难和问题,解决影响森林公安工作的重大问题。支持森林公安机关履行法定职能、严格依法开展工作,为森林公安机关创造良好的执法条件和环境。
各级林业主管部门要配齐、配强森林公安机关的领导班子,严格管理森林公安队伍,积极增加森林公安经费投入,支持民警依法办案。林业主管部门主要负责同志是森林公安队伍建设的第一责任人,分管负责同志是主要责任人,凡因领导不力而导致队伍发生问题的,要追究林业主管部门的领导责任。
各级公安机关要切实将森林公安工作纳入当地公安工作的统一范畴,统一部署,统一要求,统一检查。要与林业主管部门主动配合,积极支持、关心森林公安队伍建设,加强对森林公安机关领导班子的管理;重大部署、重要会议要安排森林公安机关参加;要积极指导、协助森林公安机关规范机构设置、理顺执法权限、完善法制建设;要在资金投入方面给予森林公安必要的支持;要加强对森林公安民警招录、培训、表彰奖励等工作的指导,以促进森林公安队伍规范化建设。
在全面建设小康社会,加强生态建设,实现林业跨越式发展的新形势下,森林公安队伍建设既迎来良好的机遇,也面临巨大的挑战。林业、公安部门和森林公安战线的全体同志要紧密团结在以胡锦涛同志为总书记的党中央周围,认真贯彻“三个代表”重要思想,团结拼搏,积极进取,迎难而上,为把森林公安队伍建设成为政治坚定、业务精通、作风优良、执法公正的公安队伍而努力奋斗。

In this Ordinance, unless the context otherwise requires-

in the case of a ship registered or to be registered by

PART II ADMINISTRATION
egistrar of Ships
The Director shall in writing appoint one or more public
officers to
egistrars of Ships.
The Registrar shall have such powers, functions and duties
as are
erred or imposed upon him by this Ordinance or any other law.
Without prejudice to subsection (2), the Director shall have and
may
cise the powers and functions of the Registrar referred to in
that
ection.
nstructions
The Director may issue to the Registrar and to other public
officers
administrative instructions not inconsistent with this
Ordinance as
appear to him to be necessary or expedient for the better carrying
out
he provisions of this Ordinance.
The Director shall publish such instructions in such manner as
he sees
Where in this Ordinance there is reference to a specified
form or
er-
that form or manner may be specified by the Director in
instructions;
if the instructions so provide, deviations from the specified
form or
er not affecting the substance thereof shall not invalidate that
form
anner.
The Registrar and any other public officer shall comply
with any
ructions issued to him.
rotection of public officers
No public officer shall be personally liable for any damage,
injury or
suffered or incurred by any person as a result of any act done
or
sion made by the public officer in good faith in the
exercise or
ormance or purported exercise or performance of any power,
function or
under this Ordinance.
The protection conferred on public officers by subsection
(1) in
ect of any act or omission shall not in any way affect any
liability
he Crown in tort for that act or omission.
PART III THE REGISTER
egister of ships
The Registrar shall keep a register of ships
registered or
isionally registered under this Ordinance.
The register shall contain such particulars in respect of
ships,
rs and their respective interests in ships, demise
charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being
oduced in legible form.
nspection, etc. of register
person may, on payment of the prescribed fee-
inspect the register in legible form;
require to be furnished with a copy of, or extract from, any entry
in
register in legible form; or
require such copy or extract to be certified as a true copy by
or on
lf of the Registrar.
ectification of register
Where it appears to any person interested that there is a
material
r in the register, he may apply in writing to the
Director for
ification of the register.
Upon receipt of an application under subsection (1) the Director
may,
n his opinion there is a material error in the register-
direct the Registrar to rectify the register; or
subject to subsection (3), require the applicant to apply to the
High
t for rectification of the register.
Subsection (2) (b) shall not apply in any case where, in the
opinion
he Director, the material error is due to the negligence or wilful
act
mission of the Registrar.
Notice of an application to the High Court under this
section for
ification shall be served by the applicant on the Director
and the
ctor may appear and be heard in the proceedings.
The High Court may, in proceedings under this section-
make such order as it thinks fit concerning the rectification of
the
ster; and
decide any question that it is necessary or expedient to
decide
erning such rectification.
A copy of an order under subsection (5) shall be served
on the
ctor and the Registrar.
The Registrar shall-
comply with any direction to rectify the register under
subsection (2)
upon receipt of the copy of an order served under subsection (6),
and
he order so requires, rectify the register accordingly.
For the purposes of this section-
there is a material error in the register if there is an error
of fact
ubstance in the register;
without limiting the generality of paragraph (a), there is a
material
r in the register if-
an entry is omitted from the register;
an entry is made in the register without sufficient cause;
) an entry wrongly exists in the register; or
there is an error or defect in an entry in the register; and
the reference in paragraph (b) (i) to an entry omitted
from the
ster shall be read as including a reference to a matter
that is
ired or permitted by this Ordinance to be entered, or to remain,
in
register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be
exercised
he Registrar of the Supreme Court or a Master thereof.
Correction of clerical errors in register
Registrar may correct, or cause to be corrected, any clerical
error or
ous mistake in the register.
PART IV REGISTRATION OF SHIPS

Registrable ships
Subject to this Ordinance, a ship is registrable if-
a majority interest in the ship is owned by one or more
qualified
ons; or
the ship is operated under a demise charter by a body corporate
being
alified person (whether or not a majority interest in the
ship is
d by one or more qualified persons), and a representative
person is
inted in relation to the ship.
A registered ship ceases to be registrable if-
being a ship registered by virtue of subsection (1) (a), a
majority
rest in the ship ceases to be owned by one or more qualified
persons;
being a ship registered by virtue of subsection (1) (b)--
the ship ceases to be operated under a demise charter by
a body
orate being a qualified person (whether by reason of the
termination
he demise charter or otherwise);
the ship or any share in or part of the ship is
transferred or
smitted; or
) the rights of the demise charterer under the demise
charter are
gned;
the ship is taken in war or hostilities, as a result of which
